These Terms govern your use of the TX Tough Trailers website and booking service. The rental of a specific trailer is governed by a separate Trailer Rental Agreement that you sign before each rental.
1. Who we are
This website and booking service are operated by TX Tough Trailers LLC, a Texas limited liability company based in League City, Texas (“TX Tough Trailers,” “we,” “us,” or “our”). You can reach us at (281) 896-7474 or frank@txtoughtrailers.com.
2. Acceptance of these Terms
By using this website, creating an account, or booking a reservation, you agree to these Terms, our Privacy Policy, and our Cancellation Policy. If you do not agree, do not use the site or book a reservation.
3. Eligibility
To book and take possession of a trailer, you must:
- be at least 25 years of age;
- hold a valid driver’s license;
- provide proof of liability insurance covering the vehicle that will tow the trailer; and
- have a tow vehicle that meets the manufacturer’s towing specifications for the trailer, including hitch rating, brake controller, and electrical connections.
We may require you to upload a photo of your driver’s license and proof of insurance before your rental. We may decline or cancel a reservation if these requirements are not met.
4. Bookings, pricing, and payment
Prices shown on the site are in U.S. dollars and are set by us. Every reservation includes the nightly rental rate, a $100 cleaning fee, a refundable $500 security deposit, applicable Texas sales tax, and any add-ons or delivery fees you select. The full amount, including the security deposit, is charged at the time you book.
Payments are processed by Stripe. We do not receive or store your full card number. By booking, you authorize us (through Stripe) to charge your payment method for the reservation total and, as described in the Rental Agreement, for damage, cleaning, dump/propane fees, tolls, fines, or other unpaid charges.
A booking is not confirmed until payment is completed and you receive a confirmation email. If a confirmation email bounces, we may contact you by phone to verify the reservation.
5. The Trailer Rental Agreement
Each rental is governed by our Trailer Rental Agreement, which you sign electronically before check-in. It covers, among other things: your responsibility for damage, loss, or theft of the trailer regardless of fault; prohibited uses (no smoking, no unpaved roads or beaches, no use during named storms without written approval, no unauthorized drivers); return condition, holding-tank, and propane requirements; and specific fees (including a $500 smoking-remediation fee, a $100 dump fee, a $50 propane fee, and a $25 pet fee). If anything in the Rental Agreement conflicts with these Terms as to a specific rental, the Rental Agreement controls.
6. Cancellations and refunds
Cancellations and refunds are governed by our Cancellation Policy. In summary: the rental charge is fully refundable 21+ days before check-in, 50% refundable 14–20 days before, and non-refundable 13 days or fewer before. The security deposit, cleaning fee, delivery fees, and add-ons are always refunded in full, with sales tax refunded proportionally.
7. Accounts
You can access your reservations through an account secured by a one-time email sign-in link (“magic link”) — there is no password to remember. You are responsible for keeping access to your email account secure. Notify us promptly if you believe someone else has accessed your account.
8. Acceptable use of the website
You agree not to:
- use the site for any unlawful purpose or to make fraudulent reservations;
- attempt to probe, scan, or breach the security of the site, or access areas or data not intended for you;
- scrape, copy, or republish site content except as allowed below; or
- interfere with the site’s normal operation.
9. Intellectual property
The site design, text, logos, and photographs are owned by TX Tough Trailers LLC or its licensors (including trailer owners who partner with us) and are protected by law. You may view and print pages for your personal, non-commercial use of the booking service. All other use requires our written permission.
10. Third-party services
The site relies on third-party providers to function, including Stripe (payments), Supabase (database, sign-in, and secure file storage), Resend (email), Vercel (hosting), and Google Maps Platform (delivery-distance estimates). Your use of the site is also subject to those providers’ terms where applicable. We are not responsible for the acts or omissions of third-party providers.
11. Disclaimers
The website is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, or secure, or that pricing and availability shown are always current. We make no warranties of any kind regarding the trailers themselves except as expressly stated in the Rental Agreement, and we disclaim the implied warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by Texas law.
12. Limitation of liability
To the fullest extent permitted by law, TX Tough Trailers LLC and its members and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost enjoyment, arising out of your use of the website or a reservation. Our total liability for any claim relating to the website or a reservation will not exceed the amount you paid for that reservation. Nothing in these Terms limits liability that cannot be limited under Texas law.
13. Indemnification
You agree to indemnify and hold harmless TX Tough Trailers LLC and its members and employees from any claims, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of your use of the website, your reservation, your use of a trailer, or your breach of these Terms or the Rental Agreement.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute relating to these Terms or the website will be resolved exclusively in the state or federal courts located in Galveston County, Texas, and you consent to that jurisdiction and venue. The prevailing party in any dispute is entitled to recover its reasonable attorney’s fees and costs. We may require arbitration of a dispute at our option.
15. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above shows when they last changed. Material changes will be reflected here before they take effect; your continued use of the site after a change means you accept the updated Terms. The terms in effect when you booked govern that reservation.
